ยง 5.113.29 Executive Order-No. 113.29: Suspension of Regulations Regarding Transportation and Handling of Certain Solid Waste Resulting from the World Trade Center Disaster

WHEREAS, on September 11, 2001, I issued Executive Order Number 113 declaring a disaster emergency in the State of New York;

NOW, THEREFORE, I, GEORGE E. PATAKI, Governor of the State of New York, by virtue of the authority vested in me by the Constitution and Laws of the State of New York, do hereby continue Executive Order Number 113, dated September 11, 2001, except that such Executive Order is amended to provide as follows:

FURTHER, pursuant to the authority vested in me by Section 29-a of Article 2-B of the Executive Law to temporarily suspend specific provisions of any statute, local law, ordinance, order, rule or regulation, or parts thereof, of any agency during a State disaster emergency, if compliance with such provisions would prevent, hinder or delay action necessary to cope with the disaster, I hereby temporarily suspend, for the period from the date of this Executive Order until further notice, the following regulations:

6 NYCRR part 364 to the extent that this part requires persons working under the supervision of government officials of the State and/or City of New York in connection with the disaster emergency to obtain permits for the collection, transportation and delivery of regulated waste to the staging areas or disposal locations owned or operated by the City of New York; and 6 NYCRR parts 370through 374 and part 376 to the extent that these parts require persons working under the supervision of government officials of the State and/or City of New York in connection with the disaster emergency to comply with hazardous waste management standards at the disaster site, during the transportation of such waste from the disaster site to staging areas or disposal locations owned or operated by the City of New York, and in connection with the temporary storage of such waste at these staging areas or disposal locations.
